Terms and Conditions

The following is in addition to our terms and conditions which can be viewed on our web site.

SETUP SITE, Inc. (referred to hereinafter as SETUP SITE) Terms, Conditions and Use Policy Applicable to the provision of software by SETUP SITE.

Control Panel and Software

a) General

"SOFTWARE" refers to any computer software provided by, or made available to any individual by SETUP SITE

All SOFTWARE provided for use to the customer by SETUP SITE remains the property of SETUP SITE or the copyright holder and is available only on licence to fully paid active customers of SETUP SITE.

The SOFTWARE may not be loaned, leased or sold. Any SOFTWARE components provided in installation packages are provided solely to provide functionality to the SOFTWARE application and may not be used in the development of further software. If SETUP SITE is acting as an agent or licensee for the delivery or provision of SOFTWARE then the copyright remains with the author of the software. Each SOFTWARE item may be subject to additional terms of use that must also be observed.

The SOFTWARE may not be disassembled, de-compiled or reverse engineered. The user accepts that SETUP SITE may restrict use of the SOFTWARE by any means available and no attempt may be made to circumvent these measures. The software may not be used to perform any illegal activities.

SETUP SITE makes no guarantee that the SOFTWARE will work on the customer's computer  and is only available for use by those using Microsoft Windows operating systems on IBM compatible machines. Failure of SOFTWARE does not constitute a reason for refund of services provided by SETUP SITE in part or whole. The user of the SOFTWARE is responsible for ensuring the SOFTWARE is suitable for his or her needs.

The SOFTWARE is provided as-is and SETUP SITE is not responsible for any loss, loss of time or money, deletion or modification of files or data, damage or destruction, malfunction of a computer system or electronic devices, electronic interference, bodily damage or loss of life to animal or human caused by the use of SOFTWARE directly or indirectly. The user accepts that SETUP SITE is not responsible for any actions made by the user with the SOFTWARE, SETUP SITE cannot guarantee that information about the user of the SOFTWARE will not be leaked, intercepted,  sent deliberately or accidentally to a third party or to SETUP SITE. SETUP SITE will not be responsible for computer viruses, trojans or other malicious SOFTWARE and it is the user's responsibility to ensure actions are taken to prevent such SOFTWARE from executing on the computer system the SOFTWARE is installed on.

SETUP SITE has no obligation to provide support, documentation, or assistance with use of the SOFTWARE.

b) Control Panel Services

The control panel service is provided as a free additional service and maybe withdrawn, in part or whole, from any customer at any time and for any reason. Once an account is terminated either by the customer or SETUP SITE then the SOFTWARE provided for access to control panel services  may no longer be used and no attempt to connect to the  control panel server may be made. All copies of the control panel SOFTWARE must also then be removed from the  user's system. The control panel SOFTWARE may not be used to connect to computer systems other than those owned wholly by SETUP SITE.

SETUP SITE re-sellers are permitted to distribute only the re-seller version of the Control Panel client SOFTWARE in an unmodified form. The re-seller version of the SOFTWARE can be identified by the text "Universal" in the application title bar. Customers wishing to have the Control Panel client SOFTWARE customized can opt to do so at minimum cost of US$350. The full terms of the customization service are available on application. The re-seller is held responsible for the misuse of the SOFTWARE and understands in such a circumstance hosting of services provided by SETUP SITE may be terminated by SETUP SITE.

Only the Control Panel Client SOFTWARE as provided by SETUP SITE  maybe used by the customer to connect to the control panel services provided by SETUP SITE. Connection by any other means whether through using a telnet client or by any third party software or any other method is considered a breach of our terms and conditions, will be considered hacking and subject to the $500 fine stipulated in clause 2 of the 'Terms, Conditions and Use Policy Applicable to the provision of Internet services' by SETUP SITE

All protocols remain the intellectual property of SETUP SITE or the copyright holder.

All information sent through the control panel services provided by SETUP SITE may be logged and archived indefinitely.
